Have you ever been in a situation where you wish you had the magic words to make it all stop? In the last video, we talked about Article 31, the military equivalent to Miranda rights (your 5th Amendment Rights). But now, we're diving deeper. We're learning the exact words you can use to invoke these rights, your protective shield during interrogation and questioning. But now, let's cut to the chase.
How do you invoke Article 31(b) rights? It's so simple and so powerful. Say it with me, “I invoke my Article 31 rights, and I want a lawyer.” Poof! Magic. That's it. That's magic. These magic words will stop the questioning and interrogation. Now, it's important to understand the implications here. Once you've made this statement, all questioning must cease.
It must stop until you have a lawyer. They're not allowed to trick you or persuade you to continue. That's the law. Now, do they break the law? Yes. Law enforcement agents and commanders break the law all the time. The best way to protect yourself is if they break the law and still try to question you. Just simply repeat, “I invoke my article 31 rights, and I want my lawyer.”
But be careful. If you voluntarily start talking to them again without your lawyer present, the questioning can resume. So, if you say these magic words and then you're like, oh, by the way, thinking that you're all of a sudden going to get some "mulligan," some do-over card because they're going to violate your rights now.
No, the key is to be strong, stay silent, and wait for a lawyer. Now, are they going to bring a lawyer to you right then and there? No, they're going to tell you to go to TDS or your Area Defense Counsel, whatever military defense counsel equivalent you have. You can also call a civilian defense counsel and be seen probably much sooner than waiting in line for suspect rights advisement at TDS.
