Think you're safe because you're off duty.
No, there is a scary boogeyman who is following you, the UCMJ.
Well, it never sleeps and it's going to come after you.
I'm Cody Harnish, UCMJ attorney.
Let's talk about off duty conduct and how we can still get you in trouble in the military.
Even when you're off duty, the UCMJ still applies.
It means if you break the law, commit a crime, or engage in behavior that discredits the armed forces you can face punishment even if it happens when you were not in uniform.
The military expects its members to maintain discipline and uphold its standards of conduct 24 seven, even while off duty.
Here are some common examples that can obviously get you in trouble.
DUI and drug use.
If you're caught with a DUI on or off post, or you're caught using illegal drugs on or off duty.
The military can still prosecute you under the UCMJ.
Domestic violence and other criminal behavior in your own home.
Can lead to both civilian and military consequences, even at the same time.
Including court martial and administrative separations.
Here's a big one. Social media misconduct.
Posting something inappropriate or damaging on social media, even while off duty, can lead to disciplinary action.
Off duty does not mean you're out of reach.
The UCMJ is the boogeyman will haunt your dreams, will give you nightmares, and will come after you even when you're innocent. So sleep tight.
